About the team

As part of the Department of Industry, Innovation and Science, the Anti-Dumping Commission (the Commission) is responsible for administering Australia’s trade remedies system.  Specifically, the Commission undertakes complex investigations into allegations of dumping and subsidisation made by Australian Industry against overseas exporters and governments.

These investigations require the Commission to work closely with Australian manufacturers and importers, as well as foreign exporters and governments.

You will work as part of the Commission-wide quality assurance teams, collaborating with investigation teams undertaking anti-dumping investigations, reviews, and other operational activities. You will provide advice throughout investigations, review statements of reasons and, as needed, be involved in merits and judicial review.

You will be part of the Legal and International Standards team, a small group of lawyers with expertise in administrative and trade remedies law. The team liaises closely with the department’s legal area, external legal providers, the Department of Foreign Affairs and Trade and the Anti-Dumping Review Panel (ADRP).

You will be required to provide high quality, client-focussed legal services. You will need to prioritise workflow in a fast-paced environment with tight legislative deadlines and collaborate across the Commission.  The role can be challenging due to the scrutiny of the Commissioner’s and Minister’s decisions by stakeholders. Maintaining a calm and resilient approach and demonstrating a high level of integrity in responding to, and engaging, with internal and external stakeholders is essential.

Your application should demonstrate that you have:

  • a well-developed understanding of administrative law and statutory interpretation principles
  • the ability to distil large volumes of information and communicate it clearly, succinctly and in a manner that non-lawyers easily understand
  • well-developed teamwork skills, including the ability to effectively negotiate, liaise and positively influence colleagues and stakeholders
  • the ability to provide evidence-based, client-focused legal advice, including identifying legal risk and developing legally compliant options for managing those risks consistently with the Commission’s strategic objectives
  • well-developed planning and organisational skills to manage workloads in delivering outcomes
  • high standards of professional and personal integrity
  • the ability to quickly acquire an understanding of and supply Australia’s anti-dumping legislation and obligations under the relevant World Trade Organization (WTO) Agreements.

What you will do

This role’s key duties are:

  • advise expert staff from non-legal backgrounds on relevant legislation and principles, both orally and in writing
  • develop legally compliant options to overcome investigations challenges and achieve the Commission’s strategic objectives
  • review draft statements of reasons and other instruments to ensure that the recommendations are legally compliant, clearly communicate the logic behind recommendations and are robust to merits and judicial review
  • where necessary, assist in developing Commission submissions to merits and judicial reviews and instructing external legal providers and
  • where necessary, assist in developing legislation and policy.

Eligibility 

To be eligible for employment in the APS and the department, applicants must be Australian Citizens.

Tertiary qualifications in the field of law is essential and admission (or eligibility for admission) as an Australian Lawyer in an Australian State or Territory is essential.

Security Clearance

To be eligible for employment in the APS and the department, applicants must be Australian Citizens.

These ongoing positions require a Baseline security clearance. The successful applicants will be required to obtain and maintain a clearance at this level.

Notes

This process is being used to fill ongoing Senior Legal Counsel and Legal Counsel roles.

A merit pool may be established to fill future ongoing and non-ongoing Senior Legal Counsel and Legal Counsel roles, should they become available within 12 months from the date advertised. Non-ongoing opportunities will be offered for a specified term for an initial period of up to 18 months with the possibility of extension (maximum 3 years).
